Alana Ecology Ltd., in its sole discretion, reserves the right to change these terms and conditions at any time without notice, although any changes will be posted here. 2. Contract Formation

When you place an order to purchase a product on our website, your order is an offer to purchase these products. We will then send you a confirmatory email setting out the details of your order. When we despatch the order, the purchase contract will be made and you will be charged, unless we have notified you that we do not accept your order or you have cancelled the order.

We may refuse to accept an order
(a) where goods are not available;
(b) where we cannot obtain authorisation for your payment;
(c) if there has been a pricing or product description error; or
(d) if you do not meet any eligibility criteria set out in our terms and conditions.

3. Pricing

All prices on the website include VAT (where applicable) at the current rates. We reserve the right to express the price exclusive of VAT but we shall show VAT separately and include it in the total price.

Product prices on our website are exclusive of postage and packing charges.

Our prices are reviewed periodically and we reserve the right to alter product prices on the website to reflect any change in the cost of the products. Whilst we make every effort to ensure that all prices on our website are accurate and up to date, sometimes errors do occur and the prices stated are incorrect. Where the correct price is lower than the one stated on our website, we will only charge you the lower amount. If the correct price is in fact higher than the price on our website, we will either contact you and discuss the pricing error before we proceed with your order or notify you of the error and cancel your order.

4. Availability

When you order an item, the website will give you an indication of its availability. These indications and any despatch times are estimates only and should not be taken as guarantees. For any item not in stock at our warehouse, we will order it from the relevant supplier. This can take as little as 1-2 days but can take longer.

5. Delivery

We charge separately for packing, carriage, insurance and other relevant charges. The appropriate rates are set out in our specified pricing structure shown under the Delivery heading of our website. We will do our best to deliver any item to you as soon as possible in accordance with its availability and our delivery policy.

Deliveries will be made to the address that you give us for this purpose.

6. Returns and Refunds

We hope that you will be happy with your purchases from Alana Ecology Ltd. However, in the event of any queries or problems, we will make every effort to ensure that we deal with them quickly and reasonably.

In most cases and in line with the Consumer Protection (Distance Selling) Regulations 2000, you have the right to change your mind and cancel your order within seven working days beginning the day after receipt of the goods. A full refund including delivery charge will be given for the returned items providing they are in their original condition.

This cooling off period and the right to cancel do not apply to contracts for goods built to order, made to a customer’s specification, to perishable goods or to sealed audio, video and computer software items.

After the seven day cooling off period and for any item which is:

(a) defective, damaged or sent in error by us, we will refund the full cost of the item including delivery charge and your costs of returning it to us. If you require a replacement, we will send you this free of charge;

(b) no longer wanted and where there has been no error on our part, we will refund only the cost of the item. The item must be in a pristine and resaleable condition in its original sealed packaging.

7. Limitation of Liability

We do not exclude or restrict liability for death or personal injury resulting from our negligence.

We will only be liable for losses which are foreseeable to both you and us as a consequence of us breaching these terms and those caused by our own negligence. We will not be responsible for any commercial or business losses (including without limit loss of goodwill, profits, contracts, anticipated savings, data or wasted expenditure) or any other indirect or inconsequential loss that was not reasonably foreseeable to both you and us at the time our contract was formed or at the time you began using our website.

Nothing in these terms and conditions shall affect your statutory rights. For information as to your statutory rights, please refer to the Office of Fair Trading.

8. Third-Party Websites

Our website includes links to external, third party sites. These links are provided by us merely as a service to users of the www.alanaecology.com site and inclusion in this site does not constitute an endorsement by or affiliation with Alana Ecology Ltd. Any goods that you order from any website to which you link from this site are subject to any terms and conditions applicable to such a website and we shall have no liability to you in respect of such sites or any goods or services you may obtain from them. In purchasing goods or services from any of the companies to which the alanaecology.com site links, you are forming a contract with the company(s) concerned, not Alana Ecology Ltd.
